INFINITY ASSETS CONCORD, LLC (DBA “COOKIES”) CANNABIS MICROBUSINESS WITH STOREFRONT AND DELIVERY RETAIL USE ADMINISTRATIVE PERMIT, MINOR EXCEPTION, DESIGN AND SITE REVIEW, AND INTRODUCTION OF AN ORDINANCE APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF CONCORD AND INFINTY ASSETS CONCORD, LLC (PL22021 – DA, DR, ME, AA) REGARDING THE DEVELOPMENT OF A CANNABIS MICROBUSINESS WITH STOREFRONT AND DELIVERY RETAIL USE LOCATED AT 5121 PORT CHICAGO HIGHWAY, APN: 159-040-037. CEQA: Categorically exempt pursuant to CEQA Guidelines Sections 15301, 15302, 15303, 15304, and/or 15305.
NOTICE IS HEREBY GIVEN that the City Council of the City of Concord will consider an application for an Administrative Permit, Minor Exception, Design and Site Review, and introduction of an ordinance approving a Development Agreement between the City of Concord and Infinity Assets Concord, LLC (dba “Cookies”) (PL22021 – DA, DR, ME, AA) for a cannabis microbusiness with storefront and delivery retail use located at 5121 Port Chicago Highway. The General Plan designation for this site is Business Park (BP), and the zoning classification is Industrial Business Park (IBP); APN: 159-040-037. CEQA: Categorically exempt pursuant to CEQA Guidelines Sections 15301, 15302, 15303, 15304, and/or 15305.
On March 1, 2023, this item was considered by the Planning Commission, where the Planning Commission voted 4-0 (AYES: Laub, Corio, Barbour, Mizutani) to adopt Resolution No. 23-05PC recommending the City Council approve an Administrative Permit, Minor Exception, and Design and Site Review, and the adoption of an Ordinance for a Development Agreement for a cannabis microbusiness with storefront and delivery retail use located at 5121 Port Chicago Highway (PL22021 – DA, DR, ME, AA).
NOTICE IS HEREBY FURTHER GIVEN that the City Council of the City of Concord will hold a PUBLIC HEARING on this matter on Tuesday, April 11, 2023, at 6:30 p.m. (or as soon thereafter as the matter can be heard) at which time and place interested persons may appear and be heard.
Please be advised that Section 65009 of the California Government Code states that in the event that you challenge the City Council’s decision on this matter in court you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice or in written correspondence delivered to the City Council at, or prior to, the public hearing, in compliance with the new COVID-19 procedures.
