City Council Matters
- CITY COUNCIL CONSENT CALENDAR
MAYOR: "The next item is the City Council Consent Calendar which is considered in a single motion. If any member of the Council or the public wishes to remove any item from the Consent Calendar, please indicate now; otherwise I will consider a motion for approval."
Staff Recommendation: Adopt the Consent Calendar as recommended.- Approving – minutes of the October 27, 2008 meeting. Recommended by City Clerk.
- Approving – an agreement in the amount of $21,536.50 with Parikh Consultants, inc. for Project No. 1283, Galindo Creek Trail Gap Closure; and to authorize the City Manager to execute the agreement. Recommended by Director of Building, Engineering and Neighborhood Services.
- Accepting - the improvements for Project No. 2015, Treat Boulevard/Oak Grove Plaza Signal Installation, constructed by Tennyson Electric Inc. of Livermore; and directing the City Clerk to file a Notice of Completion. Recommended by Director of Building, Engineering and Neighborhood Services.
- Awarding - a construction contract in the amount of $41,750 to Brown & Fesler, Inc, of Livermore for Project No. 2123, Paw Patch Lighting Improvements at Newhall Community Park; and adopting the project plans and specifications. Recommended by Director of Building, Engineering and Neighborhood Services.
- Approving – a second agreement with the Center for Executive Solutions in the amount of $25,000 for a total contract amount of $45,000 to provide leadership and management assessment services required for Fiscal Year 2008-2009. Recommended by Interim Assistant City Manager.
- Authorizing – the rejection of bids for Phase I of Project No. 2067, Citywide Entryway and Wayfinder Signage Improvements; and directing staff to rebid the project. Recommended by Director of Building, Engineering and Neighborhood Services.
- Approving – a Stormwater Management Facilities Operation and Maintenance Agreement for Cherry Tree Business Center, Assessor's Parcel No. 129-040-013; and authorizing the City Engineer to execute all similar agreements in the future. Resolution 08-61 for adoption. Recommended by Director of Building, Engineering and Neighborhood Services.
- Approving – professional services agreements with Kleinfelder, Inc., in the amount of $201,000; Harris and Associates in the amount of $109,395; EDAW in the amount of $79,000 and Cole Management & Engineering, Inc. in the amount of $57,240 to provide services for Project No. 2109, Ygnacio Valley Road Permanent restoration (Phase 2); and authorizing the City Manager to execute the agreements. Recommended by Director of Building, Engineering and Neighborhood Services.
REDEVELOPMENT AGENCY MATTERS
- REDEVELOPMENT AGENCY CONSENT ITEMS
- Approving – an agreement in the amount of $35,000 with Anderson & Associates to administer the Inclusionary Housing and First Time Home Buyer programs; and authorizing the Executive Director to execute the agreement. Recommended by Director of Planning and Economic Development.
- Approving – an agreement with Bay Area Homebuyer Agency in the amount of $42,870 for consulting services for the Agency's Housing Program and authorizing the Executive Director to execute the agreement. Recommended by Director of Planning and Economic Development.
- Authorizing – the removal of the Resale Restriction and Qualifications of Purchasers from all affordability restricted units at 1771 Broadway Street, releasing the owners from the long-term affordability provision defined in the June 14, 1983 Disposition and Development Agreement between the Redevelopment Agency of the City of Concord and Wieting, Confer and Nance. Redevelopment Agency Resolution 08-725 for adoption. Recommended by Director of Planning and Economic Development.

- LOCAL REUSE AUTHORITY STUDY SESSION
- Study Session - Presentation of the Community Advisory Committee's recommended alternative for the Concord Naval Weapons Station Reuse Plan. Report by Reuse Project Director Michael Wright.
Staff Recommendation - Hear the Community Advisory Committee's report and recommendation for the preferred Plan alternative, take public testimony, and provide guidance to frame future discussions scheduled for December 1, 2008.

Public Comment Period
This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar
All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.
Public Hearings
Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. Notice
There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
