MAYOR: I will now open the Public Comment Period. Members of the audience may address the Council on any matter that is not on tonight's agenda. Fifteen minutes is allocated to the Public Comment Period, and each speaker will be limited to approximately three minutes.

- Presentation – of Business Recognition Awards to Biocare Medical and Entisys Solutions. Introduction by Joyce Davidson-Seitz, Economic Development Specialist.
- Presentation – on the City’s preparation for the 2008-09 rainy season. Report by Qamar Khan, Director of Public Works.
- ANNOUNCEMENTS
- Announcing – the recruitment for all openings on the Appeals Board, two openings on the Design Review Board, and two openings on the Planning Commission; and setting Friday, January 2, 2009 at 5:00 p.m. as the deadline for receipt of applications by the Administrative Services Coordinator. Recommended by the City Clerk.
City Council Matters
- CITY COUNCIL CONSENT CALENDAR
MAYOR: "The next item is the City Council Consent Calendar which is considered in a single motion. If any member of the Council or the public wishes to remove any item from the Consent Calendar, please indicate now; otherwise I will consider a motion for approval."
Staff Recommendation: Adopt the Consent Calendar as recommended.- Approval of Minutes for the meeting of September 22, 2008. Recommended by City Clerk.
- Approving – minutes of the October 13, 2008 meeting. Recommended by City Clerk.
- Approving – a two-year renewal of a Lease Agreement with Concord Police Association in the amount of $37,350 annually, or a total amount of $74,700, for the use of facilities located at 5060 Avila Road; and authorize the City Manager to execute the agreement. Recommended by Chief of Police.
- Accepting – improvements for Project No. 2081, Pave Loop Road at Camp Concord, Phase I, constructed by American Engineering and Asphalt of Rocklin, California; and directing the City Clerk to file a Notice of Completion. Recommended by Director of Building, Engineering and Neighborhood Services.
- Approving – all necessary Cooperative Work Agreements with the California Department of Finance and authorizing the City Manager to execute them. Resolution 08-60 for adoption. Recommended by Director of Building, Engineering & Neighborhood Services.
JOINT CITY COUNCIL / REDEVELOPMENT AGENCY
- Joint City Council/Redevelopment Agency Consent Items:
- Approving – a second amendment to the Owner Participation Agreement with Seecon Financial and Construction Co., Inc. providing for a reduction of the loan amount due by the amount of any OSIP or sewer credits it has accrued. Redevelopment Agency Resolution 08-724 for adoption. Recommended by Director of Planning and Economic Development.
REDEVELOPMENT AGENCY MATTERS
- REDEVELOPMENT AGENCY CONSENT ITEMS
- Approving – a professional services agreement with Keyser Marston Associates, Inc. in the amount of $75,000 to provide real estate and financial advisory services to the Agency; and authorizing the Executive Director to execute the agreement. Notice to Public
Speaker's Card
Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Agenda reports are available for public viewing in a binder on the front staff desk.
Public Comment Period
This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar
All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.
Public Hearings
Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. You may request the Easy Listener Phonic Ear Personal Sound Amplifier from the City Clerk for personal use during Council meetings.

Notice
There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
