- Approval of Minutes - for the meetings of June 23, 2008. Recommended by City Clerk.
- Authorizing - the continuation of emergency action for Project No. 2034, Ygnacio Valley Road Landslide, pursuant to Section 22050 of the Public Contract Code. Recommended by Director of Building, Engineering and Neighborhood Services.
- Adopt Ordinance 08-5 - Certificate of Entitlement to Reimbursement – an amendment to the Concord Municipal Code Chapter 110 (Utilities), Article II (Sewer System), Section 110-40 (Connections Generally, Connection Permit, Maintenance of Connections and Equipment, Reimbursement for Costs of Extension), by increasing the ten (10) year limit for sewer reimbursement certificates to thirty (30) years and adding administrative set up fees. Ordinance 08-5 was introduced on June 23, 2008 by reading of title only and waiving further reading.
- Approving – the Sewer System Management Plan to comply with the State’s Order No. 2006-0003, which calls for statewide General Waste Discharge Requirements for sanitary sewer systems. Recommended by Director of Public Works.
- Approving – a three-year license agreement with GIS Planning to provide an Economic Development Property Location Website in the about of $15,000 per year and; authorizing the City Manager to execute the agreement. Recommended by Director of Information Technology.
- Approving – a professional services agreement with Enbient for technology consulting services in the amount of $40,000 per fiscal year through June 30, 2009 on Information Technology projects; and authorizing the City Manager to execute the agreement. Recommended by Director of Information Technology.
- Approving – a professional services agreement with Swagit Productions, LLC in the amount of $51,002 for video streaming services for City Council meetings and; authorizing the City Manager to execute the agreement. Recommended by Director of Information Technology.
- Approving – a three-year professional services agreement with Applications Associates for up to $60,000 per fiscal year for various computer training and; authorizing the City Manager to execute the agreement. Recommended by Director of Information Technology.
- Approving – an amendment to the agreement with Telvue Corporation in the amount of $36,000 for City Government Channel Bulletin Board services and; authorizing the City Manager to execute the agreement. Recommended by Director of City Management.
- Approving – an agreement with Magic Wave Productions, Inc. in the amount of $25,000 for video and broadcast program support services and; authorizing the City Manager to execute the agreement. Recommended by Director of City Management.

- Approving – the appointment of Mayor Bill Shinn as the City of Concord’s voting delegate, Councilmember Laura Hoffmeister as first alternate and Councilmember Helen Allen as second alternate for the General Business Meeting of the League of California Annual Conference being held September 24 through September 27, 2008 in Sacramento, CA; and directing the City Clerk to submit the information to the League prior to September 5, 2008. - Approving – the creation of the Administrative Services Manager job classification, a management pay grade M-7. Resolution 08-3493.2 for adoption. Recommended by Interim Director of Human Resources.

- Rite Aid Store (PD 06-002, UP 06-007, DR 06-005) - Application for a Preliminary Development Plan, Use Permit, and Design Review for a 14,546 sq. ft. Rite Aid Store on a 1.6-acre site located at 1990 Monument Boulevard at Oak Grove Road. The General Plan designation is Commercial Mixed Use; Zoning classification is PD (Planned District); APN’s 147-010-041, -053. Resolution 08-50 for adoption. Report by Planning Manager Deborah Raines.
Staff Recommendation: Adoption of Resolution 08-50 approving the Preliminary Development Plan. - Cowell Homeowners’ Association Appeal – Appeal of the Planning Commission’s denial of the Association’s appeal of a Zoning Administrator decision to require the preparation of an Environmental Impact Report consistent with requirements of the California Environmental Quality Act of 1970, as amended, for a Certificate of Appropriateness application to demolish the Cowell Smokestack at 4478 Lawson Court. The General Plan designation is Open Space; Zoning classification is Planned District; APN 133-260-002. Report by City Attorney.
Staff Recommendation: Continue the public hearing to July 28, 2008.

CONSENT CALENDAR:
- Joint City Council/Redevelopment Agency Consent Calendar
- Authorizing – the appropriation of $200,000 from Redevelopment Housing Set-Aside Funds to implement a three-year U.S. Housing and Urban Development Lead Based Paint Grant program in the Monument Corridor area and authorizing the City Manager to execute contracts and agreements with partner organizations. Recommended by Director of Planning and Economic Development.
- Approving – the amendment of the Owner Participation Agreement with Seecon Financial and Construction Co., Inc. for the Phase 2 development of the Metroplex Office Project with the inclusion of a reimbursable loan; approving the extension of the Public Improvements and Development Fee Agreement; and authorizing the City Manager/Executive Director to execute all First Amendment documents. Public Comment Period
This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar
All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.
Public Hearings
Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

Notice
There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
