City Council Matters
- CITY COUNCIL CONSENT CALENDAR
- Approval of Minutes - for the meetings of April 22, 2008. Recommended by City Clerk.
- Adopting– resolution calling for a general municipal election in Concord on November 4, 2008 under the provisions of laws relating to General Law cities in the State of California, for the purpose of electing two members to the City Council for four-year terms. Resolution 08-31 for adoption. Recommended by City Clerk.
- Authorizing - the continuation of emergency action for Project No. 2034, Ygnacio Valley Road Landslide, pursuant to Section 22050 of the Public Contract Code. Recommended by Director of Building, Engineering and Neighborhood Services.
- Approving – Master Professional Services Agreements with (1) Fehrs & Peers Transportation Consultants in the amount of $250,000, (2) Kimley-Horn and Associates in the amount of $250,000, (3) Omni-Means, Ltd. in the amount of $250,000 and (4) Dowling Associates, Inc. in the amount of $250,000 to provide traffic and transportation services as directed by authorized City representatives during a fiscal period. Recommended by Director of Public Works.
- Approving – a budget transfer in the of $177,400 from Project No. 1951, Citywide Traffic/Street Improvements Program, to Project No. 2012, Concord Blvd. Sidewalk (Farm Bureau Road to Sattler Drive). Recommended by Director of Building, Engineering and Neighborhood Services.
- Accepting – the improvements for Project No. 2013, Willow Pass Road and Sutter Street Traffic Signal and ADA Improvements, constructed by W. Bradley Electric of Novato; approving a related budget transfer; and directing the City Clerk to file a Notice of Completion. Recommended by Director of Building, Engineering and Neighborhood Services.
- CITY COUNCIL CONSIDERATION ITEM
- Appointment of five members to the Personnel Board, with three members to terms ending February 28, 2010, and two members to terms ending February 28, 2011. Recommendation by the Council Committee on Neighborhood and Community Services.
Staff Recommendation: Appoint three applicants to terms ending February 28, 2010, and two applicants to terms ending February 28, 2011.

- REDEVELOPMENT AGENCY CONSENT ITEMS
- Approving – a Professional Services Agreement with Ceres Associates in the amount of $54,000 to provide additional Phase II Environmental Consulting Services for 1757 Concord Avenue, APN 126-101-016: and authorizing the Executive Director to execute the agreement. Recommended by Director of Planning and Economic Development.
- REDEVELOPMENT AGENCY PUBLIC HEARING
- Consideration - of the Purchase of Real Property located at 1751, 1753, 1757 Concord Avenue (APN 112-101-016) between Sulcar Properties (Seller) and the Redevelopment Agency of the City of Concord (Buyer); and the leasing of the property to Mr. Shahdad Hefzi dba Auto Imports (Tenant), pursuant to the proposed Triple Net (NNN) Lease (Lease). Recommended by Director of Planning and Economic Development.
Staff Recommendation: Phase II environmental review has not been completed. Staff recommends the public hearing be rescheduled to a future date with notification to all interested parties.

Speaker's Card
Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Agenda reports are available for public viewing in a binder on the front staff desk.
Public Comment Period
This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar
All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.
Public Hearings
Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. You may request the Easy Listener Phonic Ear Personal Sound Amplifier from the City Clerk for personal use during Council meetings.

Notice
There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
