  1. PRESENTATION – to Bill E. Brumley, Concord Planning Commissioner, in honor of his 16 years of service to the City of Concord. Report by Mayor Shinn.

  1. CITY COUNCIL CONSENT CALENDAR
    1. Awarding – a contract in the amount of $18,799 to Silmar Flooring of Pleasanton, CA for RFB #2118, Remove and Install Centre Concord ballroom carpet. Recommended by Director of Public Works.
    2. Authorizing - the continuation of emergency action for Project No. 2034, Ygnacio Valley Road Landslide, pursuant to Section 22050 of the Public Contract Code. Recommended by Director of Building, Engineering and Neighborhood Services.
    3. Accepting – work performed by McNabb Construction for RFB No. 2103, Park Signage (CIP 2082); and directing the City Clerk to file a Notice of Completion. Recommended by Director of Public Works.
    4. Approving – a Professional Services Agreement with Barber & Gonzales Consulting Group in the amount of $30,300 to provide training and facilitation services for the Citywide employee Other Post Employment Benefits (OPEB) Task Force; and authorizing the Interim City Manager to execute the agreement. Recommended by Director of Finance.
    5. Authorizing - the appointment of Robert Barnes to serve as Concord’s representative to the Contra Costa Transportation Authority, Citizen’s Advisory Committee for a two-year term ending February 28, 2010. Recommended by Mayor Shinn.
    6. Authorizing – the Contra Costa County Flood Control and Water Conservation District to establish an annual parcel assessment for Fiscal Year 2008/09 for drainage system maintenance and the National Pollutant Discharge Elimination System (NPDES) Program by maintaining the current Equivalent Runoff Unit (ERU) rate of $35.00 per single family parcel. Recommended by Director of Public Works.
    7. Approving - agreement with Francisco & Associates in the amount of $29,000 to provide Engineering Services for the City of Concord's 2008/09 Landscape and Lighting Assessment Districts: Downtown Landscape Maintenance District, Pine Hollow Landscape Maintenance District, Landscaping and Lighting Maintenance District #3, and the Citywide Street Lighting Assessment District, and authorizing the Interim City Manager to execute the agreement.  Recommended by Director of Public Works.
  2. CITY COUNCIL PUBLIC HEARING
    1. Consideration - of a proposed amendment to the Concord Municipal Code concerning Mobilehome Rent Stabilization, increasing automatic annual rent adjustments, permitting partial vacancy decontrol, and utilizing a third party hearing officer for special rent increase proceedings. Ordinance 08-2 for introduction. Report by Mark Coon, Assistant City Attorney.

      Staff Recommendation: Introduce Ordinance 08-2 by reading of the title only and waiving further reading.

Speaker's Card

Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Agenda reports are available for public viewing in a binder on the front staff desk.

Public Comment Period

This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

Consent Calendar

All matters listed under the Consent Calendar are considered by the Council/Agency to be routine and will be acted upon in a single motion. There will not be separate discussions of these items unless a request is made prior to the time the Council/Agency considers the motion to adopt.

Public Hearings

Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. Notice

There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
